These terms and conditions cover the use of The Transcription Directory‘s website, including but not limited to its content, services, products.

This website is owned by The Transcription Directory (ABN 91 478 591 245) of PO Box 1070, Maryborough, QLD, 4650. By using this site, you are agreeing to all of terms and conditions, without modification, contained in this document and also any other policies including the Privacy Policy, the FAQs, all content displayed on the website and all agreements made during the application process.

Please read this agreement carefully before joining The Transcription Directory. Membership is only available to those over the age of 18, or if under the age of 18, with parent’s consent. By becoming a member or advertiser of The Transcription Directory, it is assumed these terms and conditions have been read and agreed to. Non-adherence to these terms and conditions after joining The Transcription Directory may result in the termination of your membership with no refund.

Products and Services

The Transcription Directory offers three different services:

A paid, 12-month membership for transcribers. This membership includes but is not limited to:
- access to our transcription tests to help to provide a rating against your current skills
- access to a listing on the website
- access to open job offers
- access to a list of possible clients with vacancies
- the latest news and blogs
- exclusive deals and discounts for transcription related products being offered by our advertisers
- help, advice and support from our extensive transcription community
A non-paid membership for clients. This membership includes but is not limited to:
- a free listing on the website
- the option for a paid advertisement on the website
- access to a list of transcribers who are currently available for work, including the rating for each transcriber
- a job listing service to recruit or subcontract transcribers
Paid advertising space for suppliers of transcription related products and services to:
- advertise a business or service on The Transcription Directory
- offer a discount, deal or special to those looking to purchase transcription-related equipment or services

Contribution to Website

It is assumed that by providing content to be posted on this website:

You (the member) are guaranteeing the information is valid and true and correct:
- Claims made towards ownership of licences, software purchases are current and up to date.
- Any admissions made in respect to skills, qualifications, work history, references, etcetera are true and correct.
You (the member) are entirely responsible for any and all information provided to The Transcription Directory by you, including amendments as required to ensure all information is correct and up to date at all times, and for ensuring the information posted onto The Transcription Directory website by us is true and correct.
You (the member) are providing The Transcription Directory loyalty-free and non-exclusive permission to reproduce, modify, adapt and publish the content for the purposes of displaying, distributing, promoting, marketing or any other lawful use of this information.
You (the member) agree that The Transcription Directory has the right to:
- Refuse to publish or remove content which we consider to violate any policy, law or is in any way harmful or objectionable,
- Terminate the membership of any individual or entity found to be in violation of any policy or law,
- Terminate the membership of any individual or entity found to have made untruthful claims in respect to any aspect of this website, including but not limited to skills and qualifications, work history, references, software purchases and licences, quality of work, etcetera,
- Refuse to provide a refund of any amounts previously paid under these circumstances.

By using this website, you agree to notify the owner or agent of The Transcription Directory of any errors, omissions, or any assumed breaches of any term, condition, policy or guideline listed on this website.

Responsibility of Website Users

All users of this website are responsible for taking precautions as necessary to protect computer systems from viruses, worms, trojan horses, and other harmful or destructive content. Any contract or transaction made between users of this site is the responsibility of those users, regardless of referral, and no agent of The Transcription Directory will be involved in any dispute between users.

This website does contain content that could be considered offensive, indecent, or otherwise objectionable by some people. This content on this website may contain technical inaccuracies, typographical mistakes and other errors. The Transcription Directory does not claim any responsibility for harm resulting from the use of this website.

The Transcription Directory does not endorse any content provided by a member except in respect to the following. The Transcription Directory has ensured:

The owner or a delegate of The Transcription Directory has made personal contact with every member listed on this website.
The owner or a delegate of The Transcription Directory has made personal contact with any references (a minimum of two) provided by any member.
All members have provided proof of identification.
All members have provided an ABN and agree that they are a self-employed contractor and not an employee, unless otherwise specified.
The owner or a delegate of The Transcription Directory has made all efforts to verify all information provided by a member to ensure that member is the person specified, is operating as an entity under an ABN and has the skills and qualifications listed.

The Transcription Directory claims no responsibility or liability for the content and activities of these linked sites, even though we seek to protect the integrity of our service and encourage and welcome any feedback about these sites.

Changes

The Transcription Directory reserves the right, at its sole discretion, to modify or replace any part of these Terms and Conditions without notification. It is the responsibility of the website user to check this document periodically for changes. Your continued use of or access to this website following any changes to these Terms and Conditions constitutes acceptance of those changes. We may also offer new services and/or features through this website, including the release of new tools and resources which shall be subject to these Terms and Conditions. A user’s continued use after changes constitutes acceptance of these changes.

Termination

The Transcription Directory may terminate a user’s access to all or any part of this website if these Terms and Conditions are breached by that user. A member may terminate a membership or discontinue using the services of The Transcription Directory by request in writing, with the understanding that no refund will be given.

Indemnification

A user of this website agrees to indemnify and hold harmless The Transcription Directory, its contractors, licensors and their respective directors, officers, employees and agents from and against any and all claims and expenses, including legal fees, arising out of your use this website, including but not limited to your violation of these Terms and Conditions.

Prices and Payments

No member shall be given access to any service on this website without a membership fee having been paid in full, if a membership fee applies. Paid members shall be contacted prior to the expiry of the membership with the option to renew the membership and a reminder to update details. Failure to respond to the offer of renewal will result in the termination of membership. The membership fee for transcribers is set for 12 months, from the beginning of each financial year, and shall be reviewed annually, and shall remain set at the same price for the full financial year, except in circumstances when we may, from time to time, offer discounts, specials and offers, valid for a stated time period, offered at the discretion of the owner or agents of The Transcription Directory.

Advertisers shall be contacted prior to the expiry of the advertising period with the option to renew subscription to the advertising space, and with a reminder to update details. Failure to respond to the offer of renewal will result in the termination of subscription to the listing or advertising space. The price for a listing or a business card size advertising space will be set for a period of 12 months and will be reviewed annually at the beginning of each financial year. Alternative sizes, styles and prices are negotiable and discussion is encouraged for advertisers requiring non-standard advertisement space.

Guarantees and Warranties

Clients, transcribers and advertisers are entities independent from The Transcription Directory. Any agreement made between these parties is not backed or guaranteed by us. We will not become involved in any disputes between these parties unless the actions of a party are in breach of these Terms and Conditions or any policy set down by The Transcription Directory, therefore resulting in termination of any membership, listing or advertising space, access to this site or other privilege ordinarily given prior to termination.

The Transcription Directory guarantees:

a paid member access to all entitlements offered with a membership
a paid advertiser access to all entitlements offered with such advertisement
the owner or agent will make every possible attempt to ensure any person or business listed on this site is legitimate

The Transcription Directory does not guarantee or promise:

that any user of this website will comply with any term, condition, policy or guideline mentioned on this website
that any client shall provide an offer of employment or a contract to any transcriber
any transcriber to be a representative of The Transcription Directory
that a transcriber shall provide work to the standard or quality expected by a client to that client
that a client shall recruit, retain or offer a contract to any transcriber
that technical difficulties will not occur from time to time, resulting in this website being unavailable for a period of time, with all efforts being made to rectify any such issues
that human error may impact anything on the website, offers or services provided by us
any person or business listed on this site is legitimate, and can do what is stated, though any available and lawful avenue has been fully investigated to ensure the legitimacy of any aspect listed on this website

Returns and Refunds

Under Consumer Law, we are not required to provide a refund for change of mind. We recognise that there is sometimes a genuine need to ask for a refund. Memberships are a commitment of 12 months as per the application and is final and non-refundable. There are situations where an agent of The Transcription Directory may consider a refund necessary, but this is at the sole discretion of the owner of The Transcription Directory and is not to be considered typical.

If a refund is granted, any merchant fees, bank charges or other charges incurred when the membership was paid or renewed will not be included in the refund amount. The refund will be provided in the same form the original payment was made.

If a product or service is purchased through an affiliate, advertiser or client listed on this website, we claim no responsibility for any transactions made and any refund or replacement obligations lie with the seller of that product or service.
